Terms of Service

Introduction

The following attendee terms and conditions ("Agreement") govern your registration and participation in any Kate Towsey Ltd. event ("Event"), including virtual events, masterclasses, and retreats to which you register. By purchasing a ticket for an Event or participating in an Event in any capacity, you have registered, accept and agree to be bound by this Agreement, and represent that you have read and understand all the provisions herein. Events are organised and managed by Kate Towsey Ltd., 15 Hill Street Balgowlah, 2093, NSW, Australia. References to "I" or "me" means Kate Towsey Ltd., and references to "us", "we", and "our" shall be construed accordingly. Reference to "you" means the entity ("Attendee") completing a booking request, and references to "your" shall be construed accordingly.

Price and Payment

Your registration is not complete until full payment is received. All tickets are valid for the named attendee only and cannot be transferred once an Event has started. If you cannot attend the Event, please contact me. The prices for attending an Event are set out on the relevant registration booking form on our website or third-party platforms. Prices are subject to change at my discretion. I reserve the right to return a payment and refuse acceptance of a booking at any time, for any reason, at no penalty to me. 

If You Need to Cancel Your Attendance

Tickets are non-refundable for change of mind or schedule. If you must cancel your booking, please submit a written notice via email. If we receive a valid cancellation request, such as illness, bereavement, or disaster, I'll process a refund as below:

  • More than two (2) months before the Event, a 50% refund will be issued.
  • Between two (2) months and one (1) month before the Event, a 25% refund will be issued.
  • Less than one (1) month before the Event, no refund will be issued.

Once approved, any refund due will be issued within 30 days of receipt of the cancellation notice to your original payment method and usually arrives in 3-5 business days. You may transfer your seat to a friend or colleague, assuming payment has been received in full. Transferring your seat will incur a US$50 administration fee, which must be paid in full to initiate the transfer. This Agreement and all our policies also apply to substitutes.

If I Need to Cancel, Postpone, or Modify an Event

I may need to cancel an event for reasons beyond my reasonable control. I shall, at my sole discretion, be entitled to cancel, postpone, or modify an Event and will not be held responsible for any loss or damage arising from any change in the Event or from the cancellation of or any change to the date(s), venue(s), or format for the Event, for any reason whatsoever. If I change, cancel, or postpone the Event, I shall give written notice of my decision as soon as reasonably practicable. In such cases, you will be offered the opportunity to attend a virtual offering of the Event, which will be held within six months of the cancellation at a time appropriate to the original time zone. Alternatively, I'll offer you a full refund for the paid amount minus a 6% transaction and administrative fee. By registering for a replacement event, you acknowledge that you have registered, accept, and agree to this Agreement and all our policies.

Force Majeure

I shall not be deemed to be in breach of this Agreement or otherwise liable to you for any failure or delay in performing my obligations under this Agreement as a result of any event or series of connected events outside our reasonable control, including, without limitation, acts of God (a "Force Majeure"), floods, lightning, storm, fire, explosion, war, military operations acts or threats of terrorism, strike action, lock-outs or other industrial action, adverse action or bankruptcy of key vendor, any legislation, regulations, rulings or omission of any relevant government, court, competent national authority or governing body, or a pandemic, epidemic or other widespread illness or disease.

Intellectual Property Rights

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event ("Content") are owned by me, related companies, and/or the Attendees attending the Event. You must not reproduce or allow anyone to reproduce trademarks or materials distributed by or on behalf of us at an Event for any reason without our prior written permission. You shall not distribute, reproduce, modify, store, transfer or in any other way use any of the Content (excepting use by the relevant delegate for internal business purposes), and in particular (but without limitation), you shall not (and agree that each of your delegates shall not):

  • Upload any Content into any shared system.
  • Include any Content in a database.
  • Include any Content on a website or any intranet.
  • Transmit, re-circulate or otherwise make available any Content to anyone else.
  • Make any commercial use of the Content whatsoever.
  • Use Content in any way that might infringe third-party rights or bring us or any of our affiliates into disrepute.

Nothing in this Agreement shall vest in you any legal or beneficial right in or to any intellectual property rights owned or used under license by us or our related companies or grant you any right or license to any other intellectual property rights of us or our associated companies. All such intellectual property rights shall remain the exclusive property of us and our related companies. It's strictly forbidden for any company, organisation, or person to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to the Event or its affiliates without our express prior permission and cooperation.

Liability

My aggregate liability to you, whether such liability arises in contract, tort (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind, howsoever arising, out of or in connection with any booking (or requested booking) made by you or otherwise in relation to an Event, shall be limited to the price paid by you in respect of your booking to attend the Event. I shall not be liable to you for: (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill; or (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind. You agree to indemnify us, our staff, affiliates, and event hosts, and to hold us harmless to the fullest extent permitted by law against all loss, costs, claims or expenses of any kind arising from any act or omission by you (including your delegates) during or otherwise in relation to the Event.

General

This Agreement (together with any documents referred to herein or required to be entered into under this Agreement) contains the entire agreement and understanding between us and supersedes all prior agreements, understandings or arrangements (both oral and written) relating to the subject matter of these terms and conditions and any such document. You acknowledge that in registering an attendee's place, you have not relied on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in this Agreement.

Data Protection & Privacy Policy

By accepting this Agreement, you agree to my Privacy Policy. If you register to attend an Event, you acknowledge that we may process your personal data in accordance with my Privacy Policy. By making a booking and providing any delegate's personal data (as defined in the GDPR) to me, you warrant that: (i) you have a lawful basis for processing the personal data, including (where applicable) fully-informed consent (as defined in the GDPR) and notices in place to enable lawful transfer of the data to us; (ii) you have brought our privacy policy to the attention of each delegate you are booking to attend an event; and (iii) agree to fully indemnify us for any and all loss suffered in connection with a breach of your obligations under this clause below.

Code of Conduct

I'm dedicated to providing a harassment-free experience for everyone, regardless of gender, gender identity and expression, age, sexual orientation, disability, physical appearance, race, ethnicity, religion (or lack thereof), or technology choices. Events and all Event spaces are for the sole purpose of discussing research operations and are not forums for social, political, or religious agendas. At our discretion, attendees, including volunteers and hosts, violating these rules may be sanctioned or expelled from the Event without a refund.

Photography and Social Media Release

By accepting my Terms of Service, you also agree to us and our authorised vendors photographing you, taking video footage, and/or making electronic sound recordings of you. Further, you also grant the irrevocable right and permission to the use of any such photographic or electronic reproductions and any other reproductions of your physical likeness and sound for any purpose, including, but not limited to, the unlimited distribution of the photographic or electronic reproductions online, and in publications in advertising, promotion, exhibition, educational materials, or for any other similar purpose deemed appropriate by us by any method or device now known or hereafter devised in which the same may be used, and/or incorporated and/or exhibited.

You understand there will be no financial or other remuneration for these recordings. Furthermore, you also grant the irrevocable right and permission to use any comments you make on social media, other public or private electronic channels, in person at or related to the Event, or Kate Towey Ltd.
